Proiectul de lege privind transparen\u021ba salarial\u0103 publicat de Senat urm\u0103re\u0219te transpunerea Directivei (UE) 2023\/970 \u0219i are ca obiectiv consolidarea principiului egalit\u0103\u021bii de remunerare \u00eentre femei \u0219i b\u0103rba\u021bi pentru aceea\u0219i munc\u0103 sau pentru o munc\u0103 de valoare egal\u0103.<\/p>\n<p data-start=\"1265\" data-end=\"1670\">Pentru angajatori, proiectul nu \u00eenseamn\u0103 doar o obliga\u021bie formal\u0103 de informare. \u00cen practic\u0103, transparen\u021ba salarial\u0103 presupune reguli noi \u00een recrutare, accesul salaria\u021bilor la informa\u021bii privind nivelurile de remunerare, criterii obiective de stabilire a salariilor, raport\u0103ri periodice privind diferen\u021bele salariale dintre femei \u0219i b\u0103rba\u021bi \u0219i posibile sanc\u021biuni \u00een cazul nerespect\u0103rii obliga\u021biilor legale.<\/p>\n<p data-start=\"1672\" data-end=\"1958\">De\u0219i proiectul de lege nu este \u00eenc\u0103 \u00een vigoare \u00een forma analizat\u0103, angajatorii ar trebui s\u0103 \u00eenceap\u0103 s\u0103 \u00ee\u0219i evalueze politicile salariale interne \u0219i s\u0103 verifice dac\u0103 pot justifica diferen\u021bele de remunerare prin criterii obiective, transparente \u0219i neutre din punctul de vedere al sexului.<\/p>\n<h2 data-section-id=\"e2xtjd\" data-start=\"1960\" data-end=\"1998\">Ce \u00eenseamn\u0103 transparen\u021ba salarial\u0103?<\/h2>\n<p data-start=\"2000\" data-end=\"2234\">Transparen\u021ba salarial\u0103 presupune ca angajatorii s\u0103 ofere candida\u021bilor \u0219i salaria\u021bilor anumite informa\u021bii relevante despre remunera\u021bie, criteriile de stabilire a salariilor \u0219i diferen\u021bele de remunerare existente \u00eentre femei \u0219i b\u0103rba\u021bi.<\/p>\n<p data-start=\"2236\" data-end=\"2564\">Scopul proiectului este de a preveni \u0219i combate discriminarea salarial\u0103. Cu alte cuvinte, angajatorii vor trebui s\u0103 poat\u0103 demonstra c\u0103 salaria\u021bii care presteaz\u0103 aceea\u0219i munc\u0103 sau o munc\u0103 de valoare egal\u0103 sunt remunera\u021bi \u00een mod egal, cu excep\u021bia situa\u021biilor \u00een care diferen\u021bele salariale sunt justificate prin criterii obiective.<\/p>\n<p data-start=\"2566\" data-end=\"2856\">Aceste criterii pot viza, de exemplu, experien\u021ba profesional\u0103, nivelul de responsabilitate, performan\u021ba, complexitatea activit\u0103\u021bii, condi\u021biile de munc\u0103 sau alte elemente relevante pentru postul respectiv. Important este ca ele s\u0103 fie clare, documentate \u0219i aplicate \u00een mod nediscriminatoriu.<\/p>\n<h2 data-section-id=\"bnceye\" data-start=\"2858\" data-end=\"2908\">Transparen\u021ba salarial\u0103 \u00een procesul de recrutare<\/h2>\n<p data-start=\"2910\" data-end=\"2979\">Una dintre cele mai importante modific\u0103ri propuse vizeaz\u0103 recrutarea.<\/p>\n<p data-start=\"2981\" data-end=\"3189\">Potrivit proiectului de lege privind transparen\u021ba salarial\u0103, angajatorii vor avea obliga\u021bia de a furniza candida\u021bilor informa\u021bii privind nivelul ini\u021bial de remunerare sau intervalul salarial aferent postului.<\/p>\n<p data-start=\"3191\" data-end=\"3464\">\u00cen varianta revizuit\u0103 a proiectului, aceast\u0103 obliga\u021bie este detaliat\u0103 \u0219i include nu doar salariul de baz\u0103, ci \u0219i componentele complementare sau variabile ale remunera\u021biei, precum bonusuri, beneficii de natur\u0103 salarial\u0103 sau alte componente relevante pentru postul respectiv.<\/p>\n<p data-start=\"3466\" data-end=\"3633\">Aceste informa\u021bii ar trebui comunicate fie \u00een anun\u021bul de recrutare, fie \u00eenainte de interviul de angajare, \u00een scris, astfel \u00eenc\u00e2t candidatul s\u0103 poat\u0103 purta o negociere informat\u0103.<\/p>\n<p data-start=\"3635\" data-end=\"3940\">O alt\u0103 modificare important\u0103 este interdic\u021bia de a solicita candida\u021bilor informa\u021bii despre salariul actual sau despre salariile anterioare. Aceast\u0103 interdic\u021bie urm\u0103re\u0219te s\u0103 evite perpetuarea unor diferen\u021be salariale istorice, \u00een special atunci c\u00e2nd acestea au fost influen\u021bate de practici discriminatorii.<\/p>\n<p data-start=\"3942\" data-end=\"4102\">Pentru angajatori, aceast\u0103 schimbare \u00eenseamn\u0103 c\u0103 anun\u021burile de recrutare \u0219i politica de recrutare vor trebui revizuite.<\/p>\n<h2 data-section-id=\"1gus7js\" data-start=\"4104\" data-end=\"4152\">Criterii clare pentru stabilirea remunera\u021biei<\/h2>\n<p data-start=\"4154\" data-end=\"4418\">Proiectul de lege privind transparen\u021ba salarial\u0103 introduce \u0219i obliga\u021bia angajatorilor de a pune la dispozi\u021bia lucr\u0103torilor criteriile utilizate pentru stabilirea remunera\u021biei, nivelurile de remunerare \u0219i, acolo unde exist\u0103, modalit\u0103\u021bile de evolu\u021bie a remunera\u021biei.<\/p>\n<p data-start=\"4420\" data-end=\"4697\">Aceast\u0103 obliga\u021bie nu \u00eenseamn\u0103, \u00een mod automat, c\u0103 angajatorii vor trebui s\u0103 publice salariile individuale ale tuturor salaria\u021bilor. \u00censeamn\u0103 \u00eens\u0103 c\u0103 trebuie s\u0103 existe o politic\u0103 salarial\u0103 suficient de clar\u0103 pentru a explica modul \u00een care sunt stabilite \u0219i modificate salariile.<\/p>\n<p data-start=\"4699\" data-end=\"4835\">Pentru personalul pl\u0103tit din fonduri publice, proiectul prevede \u0219i obliga\u021bia de a pune la dispozi\u021bia lucr\u0103torilor grilele de salarizare.<\/p>\n<p data-start=\"4837\" data-end=\"5012\">\u00cen cazul angajatorilor cu mai pu\u021bin de 50 de lucr\u0103tori, proiectul prevede o excep\u021bie: ace\u0219tia nu vor avea obliga\u021bia de informare privind criteriile de evolu\u021bie a remunera\u021biei.<\/p>\n<p data-start=\"5014\" data-end=\"5314\">Din perspectiv\u0103 practic\u0103, angajatorii ar trebui s\u0103 verifice dac\u0103 au criterii interne clare privind salarizarea, promovarea, bonusarea \u0219i cre\u0219terile salariale. Lipsa unor criterii documentate poate crea dificult\u0103\u021bi \u00een cazul unei solicit\u0103ri de informa\u021bii sau al unei acuza\u021bii de discriminare salarial\u0103.<\/p>\n<h2 data-section-id=\"1ct6vbj\" data-start=\"5316\" data-end=\"5375\">Dreptul salaria\u021bilor de a cere informa\u021bii despre salarii<\/h2>\n<p data-start=\"5377\" data-end=\"5635\">Un alt element central al proiectului este dreptul salaria\u021bilor de a solicita informa\u021bii privind nivelul lor individual de remunerare \u0219i nivelurile medii de remunerare pentru categoriile de lucr\u0103tori care presteaz\u0103 aceea\u0219i munc\u0103 sau o munc\u0103 de valoare egal\u0103.<\/p>\n<p data-start=\"5637\" data-end=\"5834\">Aceste informa\u021bii trebuie defalcate pe criteriul de sex, astfel \u00eenc\u00e2t salariatul s\u0103 poat\u0103 verifica dac\u0103 exist\u0103 diferen\u021be salariale \u00eentre femei \u0219i b\u0103rba\u021bi \u00een cadrul aceleia\u0219i categorii profesionale.<\/p>\n<p data-start=\"5836\" data-end=\"5956\">Angajatorul va trebui s\u0103 r\u0103spund\u0103 \u00een scris, \u00eentr-un termen de cel mult 30 de zile lucr\u0103toare de la primirea solicit\u0103rii.<\/p>\n<p data-start=\"5958\" data-end=\"6206\">Proiectul prevede \u0219i posibilitatea ca salaria\u021bii s\u0103 solicite aceste informa\u021bii prin intermediul Consiliului Na\u021bional pentru Combaterea Discrimin\u0103rii. \u00cen forma revizuit\u0103, CNCD ar urma s\u0103 transmit\u0103 informa\u021biile c\u0103tre solicitan\u021bi \u00een format electronic.<\/p>\n<p data-start=\"6208\" data-end=\"6458\">Aceast\u0103 obliga\u021bie este relevant\u0103 pentru angajatori deoarece presupune existen\u021ba unor eviden\u021be salariale corect structurate. Angajatorul trebuie s\u0103 poat\u0103 identifica rapid categoriile comparabile de lucr\u0103tori \u0219i nivelurile medii de remunerare aferente.<\/p>\n<h2 data-section-id=\"gcc6v0\" data-start=\"6460\" data-end=\"6520\">Raportarea diferen\u021belor salariale dintre femei \u0219i b\u0103rba\u021bi<\/h2>\n<p data-start=\"6522\" data-end=\"6718\">Transparen\u021ba salarial\u0103 nu se limiteaz\u0103 la raporturile individuale dintre angajator \u0219i salariat. Proiectul introduce \u0219i obliga\u021bii de raportare pentru angajatorii care au cel pu\u021bin 100 de lucr\u0103tori.<\/p>\n<p data-start=\"6720\" data-end=\"6856\">Astfel, ace\u0219ti angajatori vor trebui s\u0103 colecteze \u0219i s\u0103 raporteze periodic informa\u021bii privind diferen\u021bele de remunerare dintre femei \u0219i b\u0103rba\u021bi.<\/p>\n<p data-start=\"6858\" data-end=\"6896\">Raportarea va include, printre altele:<\/p>\n<ul data-start=\"6898\" data-end=\"7262\">\n<li data-section-id=\"1r8vvbj\" data-start=\"6898\" data-end=\"6948\">diferen\u021ba de remunerare dintre femei \u0219i b\u0103rba\u021bi;<\/li>\n<li data-section-id=\"77vp7a\" data-start=\"6949\" data-end=\"6983\">diferen\u021ba median\u0103 de remunerare;<\/li>\n<li data-section-id=\"1r2usu3\" data-start=\"6984\" data-end=\"7064\">diferen\u021bele privind componentele complementare sau variabile ale remunera\u021biei;<\/li>\n<li data-section-id=\"128cu1v\" data-start=\"7065\" data-end=\"7152\">propor\u021bia femeilor \u0219i b\u0103rba\u021bilor care primesc bonusuri sau alte componente variabile;<\/li>\n<li data-section-id=\"168nnpu\" data-start=\"7153\" data-end=\"7207\">distribu\u021bia lucr\u0103torilor pe intervale de remunerare;<\/li>\n<li data-section-id=\"1k2yfu9\" data-start=\"7208\" data-end=\"7262\">diferen\u021bele de remunerare pe categorii de lucr\u0103tori.<\/li>\n<\/ul>\n<p data-start=\"7264\" data-end=\"7721\">Calendarul de raportare depinde de dimensiunea angajatorului:<\/p>\n<ul>\n<li data-start=\"7264\" data-end=\"7721\">angajatorii cu cel pu\u021bin 250 de lucr\u0103tori &#8211; prima raportare este prev\u0103zut\u0103 p\u00e2n\u0103 la 7 iunie 2027, iar ulterior raportarea ar urma s\u0103 fie anual\u0103;<\/li>\n<li data-start=\"7264\" data-end=\"7721\">angajatorii cu 150-249 de lucr\u0103tori &#8211; raportarea ar urma s\u0103 se fac\u0103 o dat\u0103 la 3 ani, \u00eencep\u00e2nd cu 7 iunie 2027;<\/li>\n<li data-start=\"7264\" data-end=\"7721\">angajatorii cu 100-149 de lucr\u0103tori, prima raportare ar urma s\u0103 fie realizat\u0103 p\u00e2n\u0103 la 7 iunie 2031, apoi o dat\u0103 la 3 ani.<\/li>\n<\/ul>\n<p data-start=\"7723\" data-end=\"7813\">Angajatorii <strong>cu mai pu\u021bin de 100 de lucr\u0103tori<\/strong> vor putea raporta <strong>voluntar<\/strong> aceste informa\u021bii.<\/p>\n<h2 data-section-id=\"1x2s924\" data-start=\"7815\" data-end=\"7851\">Evaluarea comun\u0103 a remunera\u021biilor<\/h2>\n<p data-start=\"7853\" data-end=\"8116\">Dac\u0103 raportarea arat\u0103 o diferen\u021b\u0103 medie de remunerare \u00eentre femei \u0219i b\u0103rba\u021bi de cel pu\u021bin 5% \u00eentr-o categorie de lucr\u0103tori, angajatorul trebuie s\u0103 verifice dac\u0103 aceast\u0103 diferen\u021b\u0103 este justificat\u0103 prin criterii obiective \u0219i neutre din punctul de vedere al sexului.<\/p>\n<p data-start=\"8118\" data-end=\"8362\">Dac\u0103 diferen\u021ba nu este justificat\u0103 \u0219i nu este remediat\u0103 \u00een termen de 6 luni de la transmiterea raport\u0103rii, angajatorul va trebui s\u0103 efectueze o evaluare comun\u0103 a remunera\u021biilor, \u00een consultare cu reprezentan\u021bii lucr\u0103torilor, dac\u0103 ace\u0219tia exist\u0103.<\/p>\n<p data-start=\"8364\" data-end=\"8732\">Evaluarea comun\u0103 are rolul de a identifica, remedia \u0219i preveni diferen\u021bele salariale nejustificate. Aceasta trebuie s\u0103 includ\u0103 informa\u021bii privind propor\u021bia femeilor \u0219i b\u0103rba\u021bilor \u00een fiecare categorie de lucr\u0103tori, nivelurile medii de remunerare, componentele variabile, motivele diferen\u021belor salariale \u0219i m\u0103surile necesare pentru eliminarea diferen\u021belor nejustificate.<\/p>\n<p data-start=\"8734\" data-end=\"9024\">\u00cen forma revizuit\u0103 a proiectului, evaluarea comun\u0103 trebuie realizat\u0103 cu respectarea normelor privind protec\u021bia datelor cu caracter personal \u0219i confiden\u021bialitatea datelor. Prin urmare, angajatorii trebuie s\u0103 gestioneze cu aten\u021bie echilibrul dintre transparen\u021ba salarial\u0103 \u0219i obliga\u021biile GDPR.<\/p>\n<h2 data-section-id=\"mj7ri9\" data-start=\"9026\" data-end=\"9077\">Salaria\u021bii vor putea discuta despre salariul lor<\/h2>\n<p data-start=\"9079\" data-end=\"9130\">Proiectul propune \u0219i modific\u0103ri ale Codului muncii.<\/p>\n<p data-start=\"9132\" data-end=\"9334\">Una dintre cele mai importante modific\u0103ri este aceea c\u0103 prin contractul individual de munc\u0103 nu se va putea interzice sau limita posibilitatea salaria\u021bilor de a divulga informa\u021bii despre remunera\u021bia lor.<\/p>\n<p data-start=\"9336\" data-end=\"9576\">Aceast\u0103 modificare este important\u0103 pentru angajatorii care folosesc clauze de confiden\u021bialitate salarial\u0103 formulate larg. \u00cen m\u0103sura \u00een care astfel de clauze interzic salaria\u021bilor s\u0103 discute despre propriul salariu, ele vor trebui revizuite.<\/p>\n<p data-start=\"9578\" data-end=\"9838\">Totodat\u0103, proiectul introduce \u00een Codul muncii dreptul salaria\u021bilor de a solicita \u0219i primi informa\u021bii privind nivelurile medii de remunerare, defalcate \u00een func\u021bie de sex, pentru categoriile de salaria\u021bi care presteaz\u0103 aceea\u0219i munc\u0103 sau o munc\u0103 de valoare egal\u0103.<\/p>\n<h2 data-section-id=\"2dk100\" data-start=\"9840\" data-end=\"9917\">Sanc\u021biuni pentru nerespectarea obliga\u021biilor privind transparen\u021ba salarial\u0103<\/h2>\n<p data-start=\"9919\" data-end=\"10055\">Proiectul de lege privind transparen\u021ba salarial\u0103 prevede sanc\u021biuni contraven\u021bionale pentru angajatorii care nu respect\u0103 noile obliga\u021bii.<\/p>\n<p data-start=\"10057\" data-end=\"10092\">Pot fi sanc\u021bionate, printre altele:<\/p>\n<ul data-start=\"10094\" data-end=\"10410\">\n<li data-section-id=\"1po3zp5\" data-start=\"10094\" data-end=\"10149\">nerespectarea obliga\u021biei de informare a candida\u021bilor;<\/li>\n<li data-section-id=\"1b3cibu\" data-start=\"10150\" data-end=\"10202\">adresarea de \u00eentreb\u0103ri privind istoricul salarial;<\/li>\n<li data-section-id=\"1hwezp4\" data-start=\"10203\" data-end=\"10256\">neasigurarea accesului la criteriile de remunerare;<\/li>\n<li data-section-id=\"1cplbo6\" data-start=\"10257\" data-end=\"10317\">refuzul de a furniza informa\u021biile solicitate de lucr\u0103tori;<\/li>\n<li data-section-id=\"loglv4\" data-start=\"10318\" data-end=\"10360\">nerespectarea obliga\u021biilor de raportare;<\/li>\n<li data-section-id=\"dgdv8n\" data-start=\"10361\" data-end=\"10410\">neefectuarea evalu\u0103rii comune a remunera\u021biilor.<\/li>\n<\/ul>\n<p data-start=\"10412\" data-end=\"10592\">\u00cen una dintre variantele proiectului, sanc\u021biunile erau stabilite \u00een cuantum fix, \u00eentre 10.000 lei \u0219i 20.000 lei, respectiv \u00eentre 20.000 lei \u0219i 30.000 lei pentru \u00eenc\u0103lc\u0103ri repetate.<\/p>\n<p data-start=\"10594\" data-end=\"10814\">\u00cen varianta revizuit\u0103, sanc\u021biunile sunt raportate la salariul minim brut pe \u021bar\u0103.
